Leisure Membership Terms & Conditions

Use of the facilities:

  1. You will be provided with your personal non-transferable membership number/Card that you will be requested to show at the start of your activity session. If your membership number is used by anyone else with your knowledge or consent then we reserve the right in our sole discretion to suspend and/or cancel your membership.
  2. Membership fees do not cover the cost of lockers. Any property stored in lockers is stored at your own risk. Any lockers with padlocks left on for more than 48 hours will be removed. We regret that we cannot accept liability for any loss or damage that may occur to items stored in lockers. 
  3. On joining, all members are offered an induction to instruct you on the use of the equipment. We strongly recommend that this is undertaken. If you are subsequently unsure how to use any equipment, please ask a member of the team.
  4. We endeavour to ensure that all facilities, classes and equipment are available during the advertised opening times. However, occasionally, facilities or equipment may be unavailable or classes cancelled. During festive periods opening times may be altered at the discretion of the management. These circumstances have been calculated within the membership fees.
  5. You must inform us if you have sustained a personal injury elsewhere or have developed a medical condition that may have consequences for training.
  6. Suitable gym clothing and clean trainers must be worn at all times. Denim is not permitted.
  7. Equipment must be treated with respect. Please refrain from dropping weights and they should be replaced after use.
  8. Machines and equipment must be wiped down after use, left clean and dry and replaced in the correct area.
  9. You may not use the gym or participate in a class when under the influence of alcohol, drugs or any medication that may affect your safety.
  10. Only Our Gym Personal Trainers are permitted to train members in Our Gym.

Payments

  1. The Joining Fee (if one is payable) and first month’s membership fees are collected from you by us either by Debit / Credit card at time of purchase, or by Direct Debit. Joining fees are applied to cover the initial administration costs associated with setting up a new membership and direct debit agreement and entitle the member to an induction session, bookable online
  2. If any monthly direct debit payment is not received on the due date for payment, then your membership will (except in exceptional circumstances and at our sole discretion) be automatically suspended until all due payments have been brought up to date. 
  3. Should you wish to have a non direct debit account and to pay by card monthly, you can do so via the Club App but this will incur a £5 fee in addition to your membership fee. You must have a pay-as-you-go (PAYE) membership in order to do this. DD accounts will incur additional fees as outlined below.
  4. If any Direct Debit is returned unpaid or if any other form of payment is not honoured for whatever reason, you shall pay us on demand an administration fee of £20. If, despite us having notified you of a missed payment, further payments are missed, we reserve the right to, at our sole election, either suspend or terminate your membership, upon having given you written notice of our intention to do so. We may present an option to reduce the administration fee to £5 if the outstanding amount is paid online within 7 days of becoming due.
  5. A monthly charge is applied if you freeze your membership. Your membership can be on freeze for a maximum of 3 months after which your membership will automatically be un-frozen and will revert to your monthly rate. Freeze only applies to monthly memberships and will start from your payment date. Please be aware this must be actioned at least 15 working days prior to your payment date. Regardless, it is up to the discretion of the Leisure Club Manager whether you can freeze your membership or not.
  6. From time to time we may need to increase the price of membership. We will give you at least 1 full months’ notice of any incoming price increase and will make it very clear when the price increase will take effect and how much your membership will cost after the increase. During this period, you will have your usual right to terminate your membership in accordance with the membership terms and conditions and rules. If you do not terminate the membership by the date given to you in the notice, then the price of your membership will be increased in accordance with our notice.
  7. If your account has to be transferred to debt collection due to arrears on your account, the full fee to recover this debt will be passed onto you. However before your account is transferred to debt collection, you will be given the opportunity to settle your account which may also include any late payment fees.

Termination

Non contract memberships

  1. You must provide at least 30 days notice for termination. To do this, please do this within the Club’s App or by emailing [email protected].

Contract Memberships

  1. You must complete the minimum term of the contracted membership. For example, if you are on a 3 month contracted membership, you must pay until the end of the 3 months.
  2. You must notify us at least 15 days prior to the end of your contracted membership if you wish to terminate. To do this, please do this within the Club’s App or by emailing [email protected]. Failure to do this will result in your membership automatically renewing for the same contracted duration.

Special Memberships

Blue Light, Student, Carer, Friends & Family and Staff Memberships

  1. The above memberships are discounted and subsidised by the club. Therefore we will require proof of eligibility. This will then be stored onto the Leisure system. If you are no longer eligible for the special membership, we reserve the right to cancel or transfer your membership to a full paying membership plan.

Off Peak Plans

  1. If you are on a off peak plan, please refer to the off peak times here: https://stourportmanor.com/health-club/ 
  2. If you enter the club after these times, you will not be allowed entry.

Restriction of Liability

  1. The Club will not accept liability for any loss, damage to or theft of money, valuables or other personal property of members and guests. Property stored in lockers provided by the Club is stored at the owner’s risk and no liability for loss or damage thereto will be accepted by the Club.
  2. Our liability to compensate you for any loss or damage (in the case of loss or damage other than death or personal injury) is limited to a reasonable amount
    having regard to such factors as whether the damage was due to a negligent act or omission by us.
  3. The Club accepts liability for damage, accident, death, personal injury or other loss sustained by members or guests on the Club premises to the extent caused by its negligence or the negligence of its employees and agents (during the course of their employment and agency, as appropriate) unless that failure is attributable to:(a) Your own fault
    (b) A third party unconnected with our provision of services under this agreement or(c) Events which neither we nor our supplier could have foreseen or forestalled even if we had taken all reasonable care.

Bookable activities:

  1. Bookings are only accepted from members whose membership fees are up to date.
  2. Attendance for your class must be registered upon arrival at the reception desk and by the class register.
  3. Cancellation of a booking must be made no later than 2 hours before the booking is due to start. Any cancellations received within 2 hours of the start time will mean you may be blocked from booking future classes.
  4. The club operates a two strikes non-attendance rule policy. Two no-shows within a 4 week rolling period will result in a 14 day ban. 
  5. If you have an injury or illness that may affect your ability to participate, or if you are a beginner, please consult the instructor before the class starts.
  6. Entrance to a class may be refused should you arrive after the warm up has been completed.
  7. Classes and instructors are subject to change.
  8. We reserve the right to restrict a members ability to pre-book classes if the member persistently fails to attend booked classes. No refund wil be given due to a member unable to book onto classes as a result of non-attendance.

General

  1. You will be given a free QR Card with your membership when you initally sign up. Should you require a replacement, a fee will be charged. Alternatively, you can use the QR code within the Leisure app.
  2. Members must keep their personal details up to date at all times. Any changes should be made via the members area in our booking system.
  3. Smoking (including e-cigarettes) is not permitted inside the hotel premises.
  4. Food and chewing gum are not permitted within the gym area or during classes.
  5. No food or drink brought from outside is permitted within the lounge areas.
  6. We ask you to familiarise yourself with the contents of our signs, notices on display and the location of the emergency exits.
  7. You are required to abide by our policy on the use of cameras, video and mobile phones.
  8. Members must be 16 or older to use the gym, sauna, steam room and jacuzzi. Under 16s must be accomanied by an adult. 
  9. You agree to comply with the Rules of Membership which are displayed prominently in the Club and relate to opening hours, use of facilities and your conduct. We may make reasonable changes to these Rules at any time provided that we give you advance notice of the change.
  10. If we take no action or let you off any breach of this agreement or give you extra time to pay or comply, it will not stop us enforcing the terms of this agreement strictly at a future date.
  11. Under 18 years policy: In line with industry guidance members under the age of 18 must comply with our Under 18 Policy.  Members under the age of 18 are not permitted to attend group exercise classes, workshops, or inductions.
  12. We may assign the benefit of this agreement and our rights thereunder to a third party on notice to you. Your rights under this agreement will not be prejudiced.
  13. There may be occasions where we have to close all, or part of, the leisure centre of which you are a member. We will do our best to let you know of such closures in advance of them taking place, unless the problem is urgent or an emergency. We will use all commercially reasonable endeavours to ensure that such closures are outside of peak visiting hours and are kept to a minimum, in both duration and frequency. You will not be entitled to a refund of part of, or all of, your membership fees in such circumstances.
  14. We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these terms that is caused by any event that is outside of our reasonable control.
  15. We will not be liable or responsible for outstanding monies paid to a Personal Trainer. Personal Training is arranged directly with the PT and not with Stourport Manor Hotel Ltd.
  16. As a consumer, you have legal rights in relation to any services that are not carried out with reasonable skill and care, or if the materials we use are faulty or not as described. Advice about your legal rights is available from your local Citizens’ Advice Bureau or Trading Standards office. Nothing in these terms will affect these legal rights.
  17. This agreement is governed by English Law.
  18. We may terminate this agreement with immediate effect on notifying you if you are in breach of the Clubs Rules.
  19. To the best of your knowledge and belief you are in good health and not knowingly incapable of engaging in either active or passive exercise and that such exercise would not be detrimental to your health, safety, comfort, wellbeing or physical condition. Further, that you will advise us immediately should your circumstances change.
  20. We must take a picture of all active members which is stored securely on our Leisure system. This helps tackle and reduce members sharing their memberships.
  21. Adult swim times are from 7pm – 8pm everyday. 
  22. The Club’s opening hours, as amended from time to time, are displayed at reception and online at https://stourportmanor.com/health-club/
    Members must ensure they cease use of the Club facilities at least 30 minutes before the Club closes to allow adequate time for showering and dressing.
  23. No running, jumping or diving in Pool areas is allowed. Minors using the Pool must be suitably supervised at all times as required by the Club. Pool areas
    are not supervised by the Club staff at all times. For reasons of Health and Hygiene, it is necessary for all Members and guests to shower before entering
    the Pool. Showers are provided for this purpose in the changing areas and/or on poolside. Members and guests with verrucae, athletes foot, or similar
    communicable maladies must not use the Pool. Radios, lilos, buggies and anything which the Club in its absolute discretion considers to be a hazard or
    otherwise detrimental to the use of the Pool and its environs are not permitted. Members and guests are asked to wear conventional swimming costumes
    only. Babies and children are also required to wear appropriate costumes. All children under the age of 2, or not yet toilet trained must wear Aqua Nappies
    whilst in the Swimming Pool. The Pool may be reserved at certain periods for adults only sessions, swimming lessons or children’s parties. Prior notice will
    be displayed on Club notice boards. No food or drink is to be taken in or consumed in the pool area.
  24. In the interest of Safety and Hygiene, no crockery or glasses are allowed in the changing rooms, fitness areas, dance studios, swimming pool and other
    activity areas. No pets will be allowed in the Club premises, with the exception of guide dogs. Entry to the Club is only permitted at the Club reception and
    entrance. Fire exits, which are clearly marked, are there in the interests of safety and members and guests must not interfere with these doors for any
    reason. In the event of an emergency evacuation, members and guests must immediately make their way in an orderly fashion to the nearest available
    exit.
  25. If any member shall cause nuisance or annoyance to other members, guests or Club staff, or misuse the Club facilities, or breach any etiquette guidelines,
    or generally behave inappropriately, the Club reserves the right to refuse admission or suspend or terminate membership. In particular, abusive language, threatening or violent behaviour will not be tolerated. All minors using the Club must be supervised by an accompanying adult at all times. No photography (including the taking of images through a mobile phone or camcorder) is allowed in any area of the Club.
  26. These Terms & Conditions can be amended from time to time and we will notify you by email of any change.

QR Code / Membership Fraud

  1. Your QR code can only be used by yourself: Your QR code is issued solely for your use, as your membership is personal to you and only covers your use of a gym. You are responsible for keeping your QR code secure and confidential at all times. The membership card remains our property at all times.
  2. When entering through access control doors, you must ensure you scan your membership card/QR code even if the door is unlocked or if another member holds the door open for you. Failure in doing so will result in a possible suspension or termination of membership. This is to ensure all members are logged in the system.
  3. Use of QR code is monitored: In the interests of the safety and security of all our members, use of QR code and access is monitored and individuals using QR code / Access Devices may be asked to provide proof of identification.
  4. What we will do if we think your QR code / Access Device has been misused: Should we believe that your QR code / Access Device has been used by another individual or individuals we may (in our discretion) decide to conduct an investigation. If we do so we will: (a) inform you, via email, that we believe your QR code has been used by another individual or individuals and ask you to provide us with reasonable assistance to investigate the matter; and (b) following our investigation we will contact you, via email, to inform you of our findings and our proposed course of action, which may include one or more of the steps set out in paragraph 4 below.
  5. Our Right to make additional charges and/or cancel your membership: If you unreasonably refuse to cooperate with our investigation, or following our investigation we have reasonable grounds to believe that your QR code was used, with or without your knowledge and/or consent, by another individual or individuals, depending on the particular circumstances of each case, we reserve the right to take one or both of the following steps, which are in addition to any other legal rights that we may have : (a) to apply a penalty charge to your membership fees (and increase your direct debit payment(s) accordingly).  The penalty charge will be calculated as being equal to the price of a day pass (that applied at the time of use) for each occasion on which your QR code was used by that individual/those individuals; and/or (b) in the event of serious misuse of your QR code, for example, yourQR code has been used on repeated occasions and/or by more than one individual, to notify you, via email, that we are cancelling your membership with immediate effect, and no refunds will be given.
  6. Your responsibility for another’s conduct: If we have reasonable grounds for believing that you knowingly provided your QR code/ Access Device to another individual or individuals, or allowed unauthorised entry following your entry to the gym (Known as tailgating) in addition to our rights referred to in paragraph 4 above, we may hold you responsible for the conduct of the individual(s) while on our gym premises, and liable for any loss we suffer as a consequence of that conduct.

 

Access Device: the device, key-fob, or any other relevant security hardware device with built-in authentication equipment, issued or otherwise provided to you by us to enable you to securely access the relevant gym in accordance with the terms of your membership. Only one device can be registered to an account at any time, if you lose or misplace the device you need to contact member services to remove the device immediately.
